Default working in canada - work permit questions

I am a US citizen working in Canada for the past year in Vancouver on a
work permit that expires March 1, 2005. I was told that I could renew
at the border (which I found to be not true - you have to mail in
renewals).

I sent in my work permit renewal (CIC received it on Feb 8). On the
back of my current permit it says to send in the renewal 30 days before
expiry.

According to CIC, it is taking them almost 40 days to process an
application once they start working on it. Based on their website they
haven't even started working on my application.

I came across another website that stated: "If you have a Work Permit,
and apply for an extension, you usually have the right to continue to
work in Canada until Canada Immigration has dealt with your application
and either renewed your Work Permit or rejected the application."
However, I cannot find anything official on the CIC site that states
that.

1) Do I have to leave the country on March 1 if I have not received the
renewal paperwork? If I do leave can I return?

2) How does this problem affect:
a) my ability to work?
b) our health coverage?

No. It is the same as other types of visa. You are effectively extended
past March 1 until they either accept or deny your application.
Leaving is NOT a good idea since you will be out of status if you try
to return. Stay put until they decide your application.

No, you don't have to because you are in the "adjustment of status" phase.

I would advise against exiting Canadian soil until you receive your new WP.

I know tons of people on study permits who get into the same situation as
you are in, and continue studying. Our international students office has
advised us to do so in the past too, and I confirmed this with C&IC.

This should remain completely unaffected.

We just received a letter from MSP British Columbia stating that
because our immigration documents expired they have cencelled our
health coverage effective Feb 28.

Can anyone help with this?

Nothing can be done until you get an extension. At that time BCMP will
probably re-instate coverage.

Can someone tell me what eligibility for health care is in BC?

1) I am in Canada legally (implied status)

2) I am a resident of BC

3) I am paying taxes and working

Shouldn't this mean I should be covered?

If you haven't enrolled, you most certainly would not be. Go to
http://www.healthservices.gov.bc.ca/bchealthcare/ for more information.

I was enrolled and now have been cancelled because they state I am not
a resident of BC anymore. They sent the notice to my BC residence. I
have BC driver's license, I can document that I live in BC, I pay taxes
on my income from my job at UBC. Immigration Canada has told me that I
have implied status and that I can legally remain in Canada until a
final decision is made. What I don't understand is how the provincial
government can say that I am not a BC resident and not entitled to
health insurance.

Would it help to go down to the Vancouver MSP office?

Because in the opinion of MSP you don't have a valid wp, whether you have
implied status or not is not the criteria for MSP.

I have ran into the sam situation before,
MSP work according to the regulation, you need to have a
valid documents eg, work permit, to be covered.

"Implied Status" only work under CIC

They advised me to keep all the receipts and will be reimburses once you got
the permit again
if you happend to be sick etc....
