Default When to start CPV application

My Daughter has been in Australia for about 16months and has applied for
PR through her work (their idea) and her paperwork is now going through.

However, my husband and I want to apply for a CP visa as soon as she
has her PR proof but the AOS at Centre Link say she has to have been
in Australia for 2 years which wont be till next Feb plus although
she started work there in Feb 2005 she will not have tax returns till
July 2007.

How soon could we start to fill in our application for CPV once she
has her PR.

Will we have to wait until after July 2007 or would it take that long
before Centre Link asked for the AOS details and we could start to fill
in forms and send our application in knowing that it will prob be around
July 2007 before Centre Link ask her for tax details?

Sorry if that sounds confusing but once she has PR if I can start the
application process asap it would be useful rather than waiting till
after July 2007

As far as I know She needs to have PR for two years to sponsor
you.Temporary visa holders can't sponsor.

You need a sponsor before you can apply.

I am assuming that you pass the balance of family test?

She needs to have PR to sponsor, and have a total of 2 years residence
to meet the "settlement" requirement, however legal temporary residence
will count towards the 2 years.

So there may be no need to wait for 2 years after PR.

The requirements for the Assurance of Support (2 years eligible tax
returns etc) need to be looked at separately.

JAJ

My Daughters two years eligible tax returns would have to be from 2005
to 2007 (July) as that is when the tax year runs from right? Although
she had been working since Feb 2005 or would they be able to take it
from Feb 2005 to Feb 2007.

How soon do u know could we start application for CPV once it has been
established that our Daughter is a PR and could everything else be done
right up to the Centrelink AOS which may not be available for Daughter
to apply for us for until July 2007.
I know that the AOS is one of the last things that DIMIA ask for so was
wondering if once she has her PR we could start form filling.

Or I could get my cousin to do the AOS for me as he is an Australian
Citizen and been living in Australia for over 50 years.
I know he couldnt sponsor us as a CPV .

hi CAz

The short answer is yes and yes. you can start your application as soon
as your daughter has PR. For the AOS your daughter doesn't have to do
it. your cousin could or anyone else with an income of at least $40k.
The sponsor and the assurer do not have to be the same person.

be worned tho, AOS is a pain the rear. you might have to buy your cousin
a fee beers to compensate him!
