Smile What to do?

Question:

I'm not a lawyer, or play one on tv ... but I'm a USC and my wife is a tourist overstay. We filed back in may 05 and will (thank Gooodness) have our appointment for our adjustment interview in Memphis on April 12.

My question is her EAD is inching close to renewal time (pre 90 days) just before our scheduled interview. Should I go ahead and renew the EAD or wait ?


Any advice would be appreciated.

Hi Rodney,

The choice is yours. If you want to be assured of her continued
employment no matter what, it might be a good idea to renew it.

If you want to wait and see what happens at the interview, and risk her
not being able to work if she doesn't get same-day approval, you can do
that too...and then renew it once you know for sure.

We were in a similar situation. We went ahead and renewed my
husband's EAD, just in case he was not same-day approved at his AOS
interview. As it turned out, he was approved, and we didn't need the
2nd EAD. Oh well.
