What is "receipt date" after forgetting the fingerprint fee?
My neglecting to include the fingerprint fee in our AOS package
(adjusting from B-2 for my wife) got us a "Request for Initial
Evidence" (is this what everyone calls an "RFE"?) today.
Under "Initial Evidence Missing" they've checked: "Evidence of
eligibility for Ms. X (see below). The only other thing checked is
under "Other Evidence Missing" where they've checked "Other: You will
need to submit a check or money order in the amount of $50.00 for your
fingerprinting fee". It's funny to think of a check as being "evidence
of eligibility" but I guess that's what it is. If you don't pay the
fee, you're not eligible.
Accompanying that was a "Notice of Receipt" dated 19 Feb 2004, saying
that the I-485 has been received but cannot be accepted for processing
due to the fact that initial evidence was not included.
Stapled to it was the "grocery receipt" for the fees we did send. The
grocery receipt is dated 31 Dec 2003.
Her new A# is on both forms, but not on the grocery receipt which says
"A# 00000000".
Myy question is: What is my wife's "date of receipt"?
31 Dec 2003 ?
19 Feb 2004 ?
None of the above, because they're still waiting for that
fingerprint fee?
Also, she's past her I-94 expiration, so I'm curious as to whether she
is she "out of status" for now.
