Default Want to Land in Canada with PR Visa, however US H1B visa is expired

Greetings,

Please help me out.
I got my PR visa stamped in my Passport 2 weeks ago. Thanks a bunch to
the whole group.

I wanted to Land in Toronto as soon as possible, but my H1B visa on my
passport is expired. I applied for the H1B extension, and I am
expecting to get the approval in two weeks time.

Can you please advise what I should be doing after I get the H1B
approval petition. I understand I cannot come back to USA without VISA
stamping on the passport.

Can I go to Toronto/Canada and complete the PR Landing process.. then
go to Ottawa and then get my H1B visa stamped on Passport and then
return back to USA. Is this a feasible solution.?? How should I take
an appointment with the Ottawa US consulate?? If there any possiblity
of any rejection or the Consulate reject to Stamp on my Passport..??
If I don't take all these precautions, I will be struck in Canada and
could not return to US. I will be forced to go back to my Home country
India for the Visa stamping which complecates things very much.

All advise is greatly apprecaiated.

you CAN come back to the US within 30 days from Canada if you dont apply for
a US visa there and get rejected.
Approval Notice is sufficient to travel back.

Are you sure the situation has not changed after Sept 11?
My company's lawyer has advised me not to that but rather go to the
US embassy in Toronto and get a new visa stamped into my passport.

Your company lawyer is right. The risk in applying for H1B visa in
Canada (or Mexico) is that if your application is rejected you will
have to travel to your home country from there. You cannot re-enter
US if your visa application is rejected.
If you get your H1B approved before July 6th, you can do visa
revalidation in US itself. After that, it's safer to go to your home
country, get your H1B stamped and then go to Canada.

You have no risk in returning on a valid I-94 and 797 approval if you DONT
apply for a visa in Canada(and get refused) and stay in Canada less than 30
days.

The best way is to hear from INS people themselves, you know you can call
the port directly and they will tell you the same thing.

Lawyer is telling you what will make him more business....by you retaining
him to apply for a visa.

Discontinuation of Domestic Visa Service for Certain Nonimmigrant Visas,
July 16, 2004
The State Department is discontinuing its domestic resistance service
for E, H, I, L, O, and P visas. The Department will stop accepting
applications for these visa classifications on July 16, 2004. The
Department will continue to process diplomatic and official visas (A, G,
and NATO) in Washington and at the US Mission to the United Nations in
New York. This action is being taken because Section 303 of the
Enhanced Border Security and Visa Entry Reform Act requires the State
Department to incorporate a biometrics in every U.S. visa issued after
October 26, 2004. All visa-adjudicating posts abroad will have
fingerprint-scanning equipment installed before the October deadline.
Persons residing in the United States in one of the affected visa
classes may continue to reside in the country for the period granted by
Department of Homeland Security officers at ports of entry. If these
persons depart the United States and require new visas to reenter, after
July 16 they must seek adjudication of a new visa application at a U.S.
Embassy or Consulate abroad. A notice announcing the termination of
domestic reissuance service for these visas appears in the Federal
Register of June 23, 2004, Public Notice 4747, at page 35121 2004/704.

You are mixing up two very different laws.
this is a toally different thing.
This is about re-validation from St. Louis and getting return visas from the
US.

Coming back from the contiguous countries withing 30 days stands as always,
and I have not heard any review for that procedure.

The BEST in any given case is always check with the "right authorities" than
believe or infer wrong conclusions.

What if you dont have a valid visa stamped on ur passport, nor do u
have a valid i94? all you have is valid h1 approval notice?

The H1 approval notice (I-797) has a set of I-94s at the bottom of the
notice which you can tear. Look at your notice.
