Default Visa overview questions

Hi,

Just want to check my understanding of the basic principles here...
Please can someone correct anything I have got wrong!!

1) Visa 136 - Skilled Migrant. Points Test and Skill Assessment. You
are a PR once you arrive and can apply for citizenship after 5 years.
Your family can come with you and can work in Australia. You can work
in any occupation you wish to.

2) Job sponsored Visa - You are only allowed to be in Aus whilst in that
job with that company. If the job finishes you have 28 days to find
another or you aren't allowed to stay. You can't work any other job
and you are not a PR.

3) Skilled Migrant with family in Aus - not sure how this changes the
conditions if at all. May just help with the points situation. What
does the Aus family member have to do in order to be your sponsor?

Yes, thats pretty much right.

Obviously if you can possibly get 120 points the best option is to go
for a 136 PR visa.

If you can't quite get the points, and have family in Australia who can
sponsor you this is the next best option (also PR). But need to be aware
of the assurance of support requirement.

If you can't do these, then you'll have to go with the employer
sponsored route but his is usually temporary and has problems (as
you said!)

Bit more complicated than that I'm afraid

Employer sponsored visa's fall into 2 basic categories,

457 .... temporary residence only, up to 4 yrs, but you can apply for
pr visa whilst you are there, this could be a 136 if after being
there/ employed for some time you meet all the 136 requirements


ENS, RSMS, or Skill matching, you tend to be tied to that employer/area
for 2 years, but you are pr from the outset.

Best advice is to go to the DIMIA web site

http://www.immi.gov.au/index.htm

and download booklet 6 . This will give you details of the types of
visa's available, and what criteria you have to meet to qualify for
them, but it can be heavy and confusing reading for the
first 6 times!

Hi Windog,

Thank you for your reply - most helpful!

I have that booklet but the trouble is I read it through and then I
think I understand, but have trouble remembering which condition/benefit
etc related to which visa subtype!!

I have looked in to the possibilities of SIR and STNI and neither will
work for us as Garry's occupation is not on any of the eligibility lists
of the states participating.

Skill Matching and ENS are options I am going to look in to in more
depth, and I think our first step is to get Garry's skills assessed in
case we can have him as a Civil Engineer - then it would be a thousand
times easier!

Yep thats exactly what I mean It took us ages, and many
readings to work out what visa's needed what criteria, but persevere it
eventually makes sense!
