Well IT DID SCREW UP mine. Mine was DV-2003 based but the same kind of
screw-up, lies, deception and incompetence surely affects other
adjustment of status applications.
Based on the result of a FOIA/PA request (form G-639) to USCIS I got
almost my entire file (except CIA name checks).
Here are some facts:
1) the name check was submitted to FBI on 08/28/03, received at USCIS
on 09/10/03 and viewed on 09/18/03 (after a lawsuit was filed);
2) interim district director Donald J. Monica assured Senator Richard
J. Durbin that our name check requests were at FBI on 06/06/03 and
then again on 08/15/03.
The letters of Donald J. Monica clearly imply that FBI name check was
requested by BCIS much earlier than 08/28/03. That, apparently, was
not the case!!! IMHO Donald J. Monica lied to Senator Richard J.
Durbin or was completely clueless about what was going on in his
bureau!
Hadn't we sued our AOS would never go through...
