Default UK-USA married 3 years, Is it possible to Move to UK together then File for wife

Facts:
Uk-USA marriage going on 3 years, awaiting final decision on removal
of conditions for me (UK spouse) while here in states.
we want to move to the UK and live, i know we can file paperwork via
the British Consolate in NY for my USA spouse..blah blah, but is it at
all possible to go over to the UK (we will be residing with my family)
and file for her in London once there?

Simply put, no. It has been done in the past, but you would risk
deportation as the USC would have to lie in order to enter the country.
This would exclude the possibility of residence. Since it is so easy to
get a visa for US spouse, why would you want to lie your way in anyway?

The idea of being able to walk in and walk out the same day
with a visa seems wonderful to me and not a hardship at all. Plus the
spouse can work in the UK right away and not have to wait for EADs like
the K3 folk here.

there? You know that if you do leave the US and stay out for
over a year you are pretty much throwing away your greencard. If you
ever want to come back and live in the States at some time in the future
you will have to begin the process all over again.

Why don't you begin
the application for citizenship (based on 3 years of marriage) Once you
have your US passport you can live wherever you want for however long
you want.

Just a thought...

With the processing times at the consulates my question would be why the
hell would you want to do this? Anyway, I would seriously consider getting
US citizenship before moving over there so that if you want to move back you
won't have to start on the US immigration process again.

your right, we will file through the consolute...btw...we were under
the impression that even if we BOTH were-are USC that if we remain out
of the USA for longer than 2 years then wanted to come live back in
the states for any reason we would have to go the
"immigration-route"...ie: need sponsors , ect as i went through.
thoughts?

passport you are sorted for life. No more sponsors, INS/BCIS/USCIS any
more for you.

Once you're a citizen,
coming and going is no problem. You're both allowed to come back
anytime. The only way to give up US Citizenship, if I remember
correctly, is to make a sworn statement in front of a Consular
Official.

Do be aware though, that even though you may both be living
overseas, if you are both citizens, you still have to file taxes with
the IRS here in the US.
