First - he is an American and he doesn't need TRV. It is the admission what
counts - he won't be admitted for more than 6 months.
Second - law clearly precludes scenario you are describing. His visitor
status won't be extended for the reason indicated (just to meet common law
definition). Why risk deportation and it's consequences? Get married and
you'll have no problems.
