Default temporary or permanent visa for Spouse

Hi, all





My wife is planning to apply for Spouse Visa. Iam Australian PR,
residing in Australia since 2 months.We have been happily married for
the last 5 years with 2 kids.



My question is if my wife applies for a spouse visa in her home country,
will she be issued a permanent visa since we share a healthy
relationship or a tepmporary 2 year visa.



Please help me in this regard.

When were you first granted an Australian permanent visa, and what
subclass was it?



Why wasn't your wife included in your permanent visa application earlier
on (or was she included but she failed to make the validation trip?)?



These questions may well be asked by DIMIA, based on the timelines you
presented in your posting.

Hi Peter,



My visa is subclass 136.My wife was included intially in the application
but was withdrawn later so that I could sponsor her later once i get
settled in australia.





Any suggestion for the above question.

Perhaps I'm missing the point, but why/how wasn't she included? Did you
tell DIMIA you had got divorced or something?

I told DIMIA we have some family problems because of which she cannot
accompany me for the time being and intend to join me later.

She could still have validated her visa and made the move to Australia
proper later on. Has she done medicals and police checks?

You've made things a lot more complicated doing it this way.

To apply for a Spouse visa, read the Partner migration booklet. A PR
can sponsor so long as he's 'usually resident' in Australia. If you
have children and have been together 2 years (or 5 years if no children)
your spouse will get a spousal PR visa.

There will be a delay for the visa application to get processed.
Depending on what country you're from, this could range from 6 weeks to
many months.
