When you apply for the spouse visa, you apply for *both* the temporary
and permanent visa at the same time. Assuming you meet the regular
requirements:
- DIMIA then look to see are you a "long term relationship". If so,
they move to grant a permanent visa immediately; or
- otherwise you get the temporary visa and the permanent visa
application is put "on hold" for 2 years.
If your relationship ends within the 2 year period you must notify
DIMIA. There are provisions to get permanent residence immediately in
those circumstances (if the partner has died, there has been domestic
violence, or you have custody/access rights over a child). Otherwise
those whose relationships end before PR is granted are usually expected
to leave Australia.
The temporary spouse visa has full work rights, so no need for a work
permit. However some employers, especially for the better jobs, may be
reluctant to hire a temporary visa holder.
You do get Medicare, however if you want to study you'll have to pay
overseas university fees.
