Section 8 Citizenship Registration Application
Section 8 of the citizenship act enables my daughter, a
college student , to register for citizenship. The residency
requirement, however, is vague, and I would like expert opinion if
possible. She will shortly have been a resident of Canada 1 year,
except she has spent 11 weeks (summer school in England through her
university and a couple of weeks in the States) out of the country.
The application asks for dates outside Canada, but does not indicate
that listing them disqualifies her. If those absences did disqualify
her, she would still be eligible under another option on the
application, but, you can only go with one option, and can't fill out
both. You can only choose option 2 if you answer NO to the statement
"I reside in Canada and have lived here for at least one year." Even
though she was in summer school, she still had bank account, address
(parents), all her belongings, and obvious ties to Canada. Did she
reside in Canada for a year? Opinions appreciated. Thanks.
I did call CIC and ask, but they didn't really know either. A
couple of agents talked about it, and their opinon was yes, she was
here a year, but they made it clear to me it was a little to rare for
them to give an informed opinion.
