Default RFE today - will it lapse??

Hey guys,



Another update from the last (infamous) thread - my ex refused to
withdraw the I-129F petition and I faxed CSC explaining that the
relationship was over and requesting that they deny the petition on
those grounds....as expected this was ignored but now i see that we have
got a RFE today.

Does anyone know if this will lapse if he doesn't respond in any way??

I just want to have this whole mess over and done with and be able to
travel up to the US without worrying about problems at POE because of a
pending petition...

It really is a moot point I believe- as I am sure you will not go to the
interview, no visa will be granted.



However, as you have an RFE, why not take the time to send a letter to
CSC, in response to the RFE, formally stating that you wish to withdraw?

She can't withdraw. It's not her petition.



She could try to tell them that the relationship has ended, so it would
be appropriate for the CSC to deny the petition.

Yes, you're quite right, I can't withdraw it....

I faxed them a week ago explaining the situation and that neither party
had any intent to marry but the RFE has been sent out....

Might just wait and see if he does anything about it....

to directly answer your question: YES the RFE will expire or lapse.

My understanding is that every RFE has a date certain by which a
response must be received, or the petition is denied. So if your ex-
fiance doesn't respond, his I-129F petition will be finished.



Even if he does respond, however, if you do not attend the interview for
a visa, no visa will issue no matter what happens with the I-129F. Once
it clears that stage it does become *your* petition - and thus, you can
get someone's attention in a way you might not be able to now.

Reading between the lines, is there someone else in the US who wishes

I think that is a pretty wild assumption. She already said she wants
to travel to the states and not have to worry about the pending I-
129F petition.



If there were a petition out there with my name on it, that I had
no control over, I would like to know when and where it would
expire as well.

No, there is definitely no one else that would be filing for me!

I just want to have the whole thing over and done with and the consulate
has told me that until it lapses that I might have problems entering the
US - this is a concern since I have family living up there...thats the
reason for concern...
