It is my understanding and Andy Platt will probably confirm this
but your H-1B is valid as long as you are still employed with the
same employer.



Applying for residency does not negate the H-1B. Only being terminated
or leaving of your own choice will do that.

Just curious. What basis are you applying for residency? Not many
people continue to say green card application or waiting for a green
card. They talk about adjusting status. Particularly when the
adjustment is based on marriage to a US Citizen. Since this is the marriage-
based forum, I'm assuming that is your case as well. Just a nit pick.
Don't mind me. It is late and I should be sleeping zzzzzzzzzzzzz

Sorry Rete, yes it is AOS I have been married over a year and been a
little silly leaving the AOS so late.



One other question regarding the AP. As I am currently on an H1-B, which
Application type am I applying for in Part 2?



b. I am a permanent resident or conditional resident of the United
States and I am applying for a re-entry permit.



OR



d. I am applying for an advance parole document to allow me to return to
the US after temporary foreign travel.



This is for AFTER my H1-B visa expires in May, just in case my AOS
hasn't gone through by then.
