Default Q Mr Miller ref PR to PNP

Mr Miller,

If you can help, a little extra advice would be
appreciated on this subject to clarify the situation. I have looked
into PNP info on CIC website, application forms etc.

BC scheme says
"A person nominated under the provincial nominee program may apply for
a permanent resident visa through Citizenship and Immigration Canada
(CIC) under the provincial nominee category " but it doesn't give much
more in depth detail, nor does CIC site. Also we have already applied
for PR, so situation is back-to-front in our case (but at least all
the hefty paperwork has gone off for PR).

Our scenario would be: PR
already submitted, fees paid etc. Wife obtains BC nursing registration
approval, applies for employment on PNP scheme, gets job offer working
on the interim registration permit before taking CNO nursing exam,
employer applies to BC gov't for PNP. We complete PNP forms and send
to CIC to apply for PNP.

Q1. Do we make written request sent with PNP
forms to change from PR to PNP ?

Q2. Fees have been paid so is there
any adjustment to make, apart from still having to pay outstanding
RPRF costs, medicals etc ?

Q3. Do we have to resubmit all the
original paperwork again or do CIC transfer the case file 'as is'.


Q4. From what I can make out spouse of primary applicant has same
rights as spouse on landing and can work without restrictions, access
healthcare after 3 months, etc, as PNP for both applicants basically
is the same as PR for rights etc once granted ? Can you clarify this ?


Sorry to go back over previous query, as these are final questions
on this subject (I hope). Sincere thanks for any help and
clarification you can give.

As I have already answered the similar question at least twice in past few
days - you cannot change the class during process. You will have to withdraw
pending application and re-apply in PNP class. This includes paying new
application fees.

And yes, principal applicant all accompanying dependants once they land as
PR in Canada have the same rights as Canadians (except the right to vote in
certain elections), regardless which class application was processed under.
