Default PR sponsorship within or outside of Canada

Hi. Please, can somebody give me advice about applying for PR. I have
Canadian fiancée, we have been living together for three years in The
Czech Republic and then we have moved to Canada. It is more then year,
what we are here. But I am staying here on tourist visa, therefore
every 6 months I am leaving country and coming back. So far I had no
troubles with it. I came here to see if I like Canada and to decide if
I want to live here. Now we want to start the procedure of
immigrating. We have decided that the best for us will be - common law
sponsorship and to apply from outside of the country. I have read that
it is faster and therefore I already did my medical examination here
in Canada. I am about to send my application. But I am not sure if it
is correct. My questions are:
1. Could I do it this way?
2. If I send my application I have to leave in 6 months again, can I
prolong my visa here?
3. Is it really faster to apply from outside of country?

While processing of applications outside of Canada is presently faster in
most cases the issue in you case will be whether you can meet the definition
of Common Law Partner and have the documentation to prove the realtionship.
I note that you describe your partner as your Fiance. If there is an
intention to marry? If there is it might be better to marry and process as a
legal spouse.

Hi Jim.

Thank you for your advice. For proving of our Common Law Partnership
we have photos (we are living togeter for long time), airline tickets
(we were treveling a lot) and also letters from our friends (from
Czech rep. and also from Canada) confirming our seriuos partnership.
Do you think that we could have troubles to meet definition of Common
Law Partners? We want to get married but I want to have a nice
ceremony, to invite my family and friends and not to rush just to sign
papers in Sity hall.

Could be problem that my stay in Canada is with breaks (when I had to
leave the country because of my turist visa)?

What you just listed doesn't prove that you are meeting definition of
common-law partners. Please read the definition here:

You need to prove that you are living together (cohabiting) in conjugal
relationship and have been cohabiting in such relationship for at least 12
months. If you can prove it then you shouldn't have problems.

Photos prove only that you were at the same spot at the time photo was
taken, not that you live together. They are still needed (among other
evidence) to document that it is a long term, real relationship, but you
need to show evidence clearly showing that you live and have lived together
at the same address in conjugal relationship. So - lease/rent agreements in
both names for the place(s) you live/d together, utility bills coming to the
same address in both names or one in one name while the other in other
partner's name (but for the same place) and other formal documents showing
that you have and had the same address in claimed periods is just the
minimum what you should show to prove it.
