Default Petitioning for a child

Hi all, I have a child from a previous marriage for which my ex has
the legal custody. When my actual wife (USC) filed the I-130 petition
for me my ex didn't want my kid to come with me to the US so we didn't
filed a I-130 petition for him. Now my ex has finally agree to let me
take the kid with me, I know the CR1 visa is not derivative as a K1 or
K3 and I'd like to know what are my choices now.

My I-130 petition has been approved and we're now on the final steps
of the NVC process, pending to send the DS-230 form and after that the
case goes to the consulate.

Any help is appreciated!

Hi:

Your wife should NOW file for her step-son. Note the I-130 asks for
information on OTHER I-130's -- so disclose this -- AND the approval
notice of the visa petition for you.
