Our visa has been denied!
We are applying for RSMS (Regional Sponsored) visa. Employer is
sponsoring hubby. After successfully passing the TRA, the employer
applied for sponsorship from the Reginal Certifying Body which was
passed. Then all docs were sent from us and from employer to our agent
in Perth, who went through everything and then submitted the visa
application to DIMIA London.
Application was received 31 March. The CO emailed agent to say that
there was nobody nominated for sponsorship, (We thought that the
employer had done this 2nd stage, he thought that the agent was going to
do it), and that we had 28 days to submit it. So fine, we thought, a
bit of a glitch, but we can get it sorted out. Then today we received a
copy of a letter which DIMIA London sent to our agents in Perth, dated
12th April. This letter was from a new CO (the other one is away), and
said that they were denying the visa on the grounds that there was no
nomination! What happened to 28 days?!
Agent has been in touch, and DIMIA say that we have no right to appeal,
and that we will have to reapply and LOOSE our visa fee.
Words cannot describe how BLEAK we are. This has been a total balls up.
Between the employer and the agent and DIMIA things have gone very wrong
somewhere. We should practically have the visa by now, and now we have
to start all over again. It seems so ridiculous that DIMIA have turned
us down just because of something that could have been provided in a
couple of weeks.
What are we going to do now?

I have no idea but wanted to wish you well.
Just a thought, but have you been on to your agent. What do they say.
If they say it was down to them, would DIMIA think again.

Yes, we have been onto our agent, and they are trying all they can to
get the case reopened. But the senior CO in London are refusing at the
moment. I am hoping that when the first CO comes back next week they
may reconsider. The agent basically says that it is the employers fault
for not completing the nomination stage. But I do feel that they should
have checked that this was all completed BEFORE they sent the
application to DIMIA. We really can't afford to spend another

All I can do is send you Karma. I am so sorry to hear about this - you
must feel sick and so frustrated. I hope you manage to reapply and that
things go more smoothly this time round

This must be so difficult for you, but one is for sure you are telling
people who do understand the effort and hard word you have gone through.
Maybe when your CO gets back and your situation explained. things could
be sorted out?

Oh no you must be gutted to say the least. I really hope the original CO
can help sort things out for you. The agent- I'm sorry but shouldn't
they get a kick up the a*** it is their job to check and double check
everything, that's what you pay them for !!

There are obviously some serious questions that need to be asked here,
but the bottom line is you must reapply. A DIMIA nomination form *must*
be provided at the same time as (or before) the visa application.
When reapplying, check to see if it's necessary to send the application
to Australia. ENS visa processing has been repatriated onshore and the
same may be true for RSMS. Check the latest version of Booklet 5 from
the DIMIA site.
Exploring any option other than reapplication will just mean
wasted time.

Hi
As everyone said I have no words to say I wish you will be Ok next time.
in my opinion your agent should have checked all these before he
submitted it to the DIMIA office. He should have known (if he is a
experienced and competent agent) that employer sponsor letter or
certification should be attached with the application and if you had not
done that, he should have informed to you. This could have helped you to
sort out the matters. Anyway no need to waste time in digging what
happened and as jeremy said :read* once again the most latest booklet
and reapply. I hope your agent would be more careful this time.
