Default Need to renew passport, what about visa?

Hi All,

My UK passport expires end of May. I am on a H1B visa which is
valid until sometime in 2006. However, the visa in the passport has
never been renewed (still has old date of 2003). I am aware this is not
an issue since my I-94 is valid. However, since I am about to send my
passport to Washington along with the C1 form and unbelieveable payment
for about $150, I need to know how to get my new visa entered back into
my new passport. I called Washington, but they say the computer is down
until at least tomorrow.

Any ideas?

A passport is
defined under US immigration law as a document, or a collection of
documents. You can carry multiple passports. It's not uncommon for
someone to have their valid visa in an old expired passport, and also
carry a valid passport. A passport is defined under US immigration law
as a document, or a collection of documents.

OK. but my visa isn't valid. My
I-94 is valid but I never got the visa renewed in my passport when my
H1B was extended.

So what are your travel plans?
You'll need the new visa to get back in from a trip over 30 days, or a
trip outside of the contiguous or adjacent territory around the U.S.


Have you made arrangements to get a new visa stamp yet?

Ah I see your point. I can can just get a new passport and
put the new visa in it when by I-94 is returned. I have another post in
this forum about that, which is now what the problem is. I can get a new
passport that's understandable, but I can't leave the country until my
I-94 comes back from the INS.

If you get a new visa in your new passport, then they'll give
you a new I-94 upon your return to the United States.
