Default Need help fast on tax form problem. K-1 interview in 2 weeks

I am united states citizen and fiance is in brazil. she had K-1
interview a week ago, and was told i need a co-sponsor that can provide
last 3 years of tax returns with W2's. I now have a co-sponsor. The
thing is, his 2000,2001 and current year to date income is fine and they
all meet the poverty guidelines, but the 2002 (last years) tax return is
about $400 (yes, just $400) short of the guidelines of poverty.



I have heard if the most recent tax return doesnt meet the guidelines
(2002), no matter about the 2000,2001 or current years income, that they
will DENY the K1 visa at her next interview in two weeks. Does anyone
know if thats true? is it possible?

it is possible they will deny..... yes and its possible they
will say okay

They have their own guideline to go by. It's the same one you and I have
seen. However, it's just a guideline.
The requirement is still the same.
You MUST PROVE THEM THAT YOUR FIANCE WILL NOT BE A BURDEN TO THE SOCIETY.
One of those things to establish it is to fill out the affedavit of support.
You can have all of the W2s of anything you want. The case will be denied if
they don't see that you have enough support for your fiance.

Does the co-sponsor have 5 x $400 in assets?

Yes he does. He has it in stocks through 401-K which he is 100% vested.

I don't know if this would count, since he can't liquidate the 401-K
under normal circumstances. But, then again, you can get hardship
withdrawals (medical, school, foreclosure, etc) and also borrow up to 50
percent from our plan.
