Default Motion to reopen: wait or cancel

Hi!
I would like to address this question to this forum as I see that my lawyer
is not as competent as we thought at the beginning.
Me and my wife (she is a US citizen) sent I-130 and we've got approved.
Immediately after that we send the whole package I-485 to our local office
[ New York ]. After three month we received a letter from the office
stating that my petition is not approved and that they close the case. Our
lawyer told us that this is an obvious mistake (mistake is a keyword,
particulars a meaningless)and that we have to send a "Motion to reopen"
right away.
Now we have been waiting for almost a year since we send it and nothing
happens. We've been talking with our local Congressman representative, but
for no particular effect.
The question is if I am to wait for my motion or I am to cancel it and
resend everything ( I-485 package) and wait for another 3 months?
Since I am asking for your opinion and not legal advice, feel free to say
whatever you have. May be you heard similar cases or something like that.
