Default moral torpitude and drink driving

Sorry if this has been asked many times before but I cant find a
definitive answer.

Will be going on the visa waiver as uk citizens just for a 3 week
holiday
husband had a drink driving conviction over 9 years ago, nobody hurt,
car not crashed or anything, £500 fine, 12 month ban but no points
on licence.

would it be honest to tick no re moral torpitude definitly dont want to
lie as dont want to risk short holidays in the future

if he does need to tick yes what happens? will he be refused entry?

classed as spent in UK now although I realise we are talking US law and
not UK law
any adive much appreciated
unable to find anythin on immigration website can anyone provide a link?
Thanks

This is indeed true.
