Default Marriage Certificate from India as per Hindu Marriage Act

Hi All,

Anybody please let me know where from we should get the
marriage certificate from India as per Hindu marriage laws/Act.

DIMIA
is not accepting the certificate issued from the
corporation/municipality authorities on a 50Rs stamp paper. Any other
alternatives to this pleaseeeeee,..........

Thats strange they should accept the
certificate mine was from the registrar office in chennai where we got
married so that sounds very strange to me that they are accepting that
certificate mine was accepted by dimia

Hi Prince,

A client from Kerala has
recently gone through this with New Delhi, however I don't know whether
you've just struck a local problem with an ASPC officer who may be
unaware of the law in India.

Email me if you want and I'll ask Arun if
he wouldn't mind explaining the law to you.

Hello Prince,

Got
stuck on marriage certificate. I will tell you the procedure hopefully
it helps

a) To get an marriage certificate from India physical presence
of bride and groom is required at the Registrar of marriages because
they will be clicking a photo using the camera attached to their
computer.

b) The other way of pacifying your case officer is to show
him that your wife is staying with you for so and so time. You can send
photocopies of the passports where residence visa stamp is there. You
can also get an Marriage affidavit from Indian embassy. And above all if
your passport shows both as spouse... send the attested photocopies. You
can also send the birth certificate of your child showing you as his
parents.

I did it like this and am thru and there is no request for
marriage certificate till. Who knows they ask for it later. Was in hurry
so couldnt checked the spellings, grammar etc. Hope you understand the
post.

The relevant office for issuing the marriage certificate is that of the
Registrar of Marriages for the marriages that fall under the purview of
the Hindu Marriage Act 1955. Each of the States have different
administrative mechanisms on how the certificates are issues and the
Rules (Regulations) governing them are formulated by the States under
the Act. Please browse this link for more information ]http://law.i-

There are other
Acts such as the Special Marriage Act 1954 which cover Christian
weddings and inter religious marriages.

An extract of the marriage
register issued in a stamp paper or plain paper issued by the
Registrar's office should be valid and if it is not an extract of the
register, I guess the validity would be questioned.

HI KS,
I have submitted the certificate issued by the
registrar of marriages and it is on 10Rs stamp paper stating that all
the details furnished in this certificate is the extract from the
registrar record. But unfortunately my CO refused to accept this
certificate. In this case if I get another certificate from the Indian
Hig comm, will it be accepeted or a certificate from the temple where my
marriage was performed is enough.

Hi Prince,

I did forward your email to Arun but of course
whether he chooses to contact you or not is a personal choice. I think
he would largely agree with KS Adityan.

I can tell you that the
Kerala authorities have a website at
http://www.kerala.gov.in/dept_registration/pearl.htm for
their "Pearl" (project for the effective administration of registration
laws) which is at least the equal of any similar program in Australia
and leads you directly into contact with the people who deal with
marriage registration there, but Arun could explain how to penetrate it
better than I can. You still need to be Indian to deal with Indian
officials, no matter how admirable the website is :-)

Dear Prince

I guess the problem here is that the extract from the
register is not signed by an authorised person at the Registrar's
office. It may be an oversight in which case it can be corrected easily
by submitting another one with the signature and the seal.

BTW, an
extract doesn't have to be on a stamp paper. Only a voluntary
(statutory) declaration should be. Of course the procedures vary between
states.
