Default L2 VISA, SSN & EAD... questions...

Hi,
My wife an I have just moved to NJ, from Australia.
My wife is on an L1 VISA, and I am on an L2 (as the spouce).

We've been in NJ now for only 1 week.

We're going to be applying for our SSN's this Friday - but I'm unsure how to answer the question 3 regarding status.
There seem to be 4 options.
1 - US Citizen
2 - Legally here - and can work...
3 - Legally here - and can't work
4 - other...

My wife is obviously #2, as she's on the L1 VISA, via intra company transfer.

I think that I'd have to put #3, because I don't have an EAD work authorization yet? But i believe that they won't issue me a SSN if I select #3, without me providing something from another US department saying that I need one...

I have no idea how to proceed from here, as I don't want to tick #2, as this is probably incorrect, and will likely cause me all sorts of problems.. and if I tick #3, then I may as well not bother applying for one at all, because I don't have some other document they're interested in.

If anyone else, has experience, in the order in which SSN's and EAD's should be applied for, then I'd really appreciate knowing about the experience...

Hi there,

Maybe is not fully helpful, but I will tell you my experience. Y had same issue. I am L1 here, and went 2 weeks ago to SS office, and I had the same question for my wife.

Therefore, we did not put anything there, and handed the application to the woman there. Once she was keying in the details, we told her the truth, that we did not put anything there, because we were not sure about what to tick. I expected her deportating us or something, but she said "no worries, I will fill that for you".

I have read in many forums that the person that attends you has many to do with the way your application will be treated. Anyway, the application went through, and SSN for my L1 wife must be here shortly. Really dont know what it will say in terms or working status (I suppose allowed with DHS authorization), but marriage certificate worked (along with arriving details and passport for her), and SSN will be here, that is for sure.

So, my recommendation is not to lie. I thought about doing so, but at the end, the best thing is to be fair, I guess.

Hey, maybe I am late, but drop me a line when you are done, i am just curious.

Btw, my wife applied for EAD couple of weeks ago and has the Biometrics appoint in half a week. Did you do so? Does it take long to get the EAD?

Hi there:

You also have the legal right to work in the US on a L-2 visa. This bill was passed a few years ago so you should always check that box. I am from the UK and came to the US on an L-1 and my husband had an L-2. We now have our green cards. You should apply for your green card in about 6 months via your wife's company and you'll probably receive it in about 2 months (believe it or not). My friend just received her green card after 1.5 months and she is from China. If you need an OUTSTANDING immigration attorney, please let me know. Good luck in New Jersey. Trish

Hi Trish,

Please give me the attorney details and also let me know whether you did it in EB-1.
Is there any prefernece for persons on L-2.
