Default L1 to H1 visa

I wish to know if my L1 visa can be transferred to a H1, even though my
L1 has not been validated. If I get a tourist visa, not a waiver visa
would I still be able to obtain a H1 visa at a later stage. Also do you
know if I have to cancel my L1 visa. The details of my situation can be
seen below.

My fiancee has transferred to the USA on a L1b visa (for
three years), I have also been given an L1b visa from my company which
has not been validated since the job fell through at the last minute. I
have come over on a waiver visa to be with my fiancee but have to go
home since my three months expires. We are planning to marry in more
than a years time, so I cannot get an L2 visa. I wish to stay with him
in the US and also wish to work since I am a specialised engineer and am
worried about never being able to work again if I stay unemployed for
too long. I do not know what I should do, or if there is someone I can
talk to for advice. For example can I go to the US embassy in London to
ask them questions.


I'm abit stuck at the moment any advice is
welcome...not just get married!!

L1 to H1 possible
B1/2 holder can still apply for H1
your L1 can be
cancelled, maybe at the POE, not sure

to be with him you will need to
apply for visitors visa, non-immigrant, but you have to prove ur r/ship
exists. will allow u to spend 6 months in US. do not rush to apply. read
other similar posts first.

If you wish to
work as an engineer, probably the proper immigration option would be an
H-1B. However, you would need a job opportunity from a US company and
you need to be careful because the H-1B cap is approaching fast.

You
obviously cannot work on the VWP or a B-1/B-2 visa, so you need to look
at work status options. the most common are the H-1B and the L-1,
although there are others they may fit your situation (E-1 or E-2?)

Unless you want
to start your own business or are transferred from an existing business,
you most liley need to find a job offer in the US. (Be mindful of the
H-1B cap though)
