Default K-1 visa interview was yesterday. need co-sponsor and his last 3 years tax info

My Fiance had interview yesterday and was told that i needed a co-
sponsor as i am self employed and didnt quite have enough income. They
told her to make sure i provide a new I - 134 with 3 years tax returns,
and W-2 from co-sponsor. The question i have is this, I have a co-
sponsor. He was single in 2000, and 2001. he married in 2002 and filed
joint with his wife and her 2 kids.

In the year 2000 he made more than enough for the household, and in 2001
only missed the income requirement by a few hundred dollars, and in 2002
was married and filed joint with wife and kids, and still made enough
counting his household of 4 and my fiance and her daughter which makes a
total of 6.

my question is this, will the 2001 return that was just a little bit
short be a problem? and also i have the W2 for all years except 1 W2
from his wife as she worked 2 jobs that year. Please note that even
though i dont have 1 of the W2 of hers, the 1 i do have, with his, is
more than enough to meet the guidelines. I just didnt know if i had to
supply her other w2 if its not needed to show income level, and it DOES
show on the joint return anyway> i know this seems really complicated
but its really not. any help would be great.

Wes,



Who is the co-sponsor? That's the person whose W-2 you need,
because that's the person whose income is going to be looked at
along with your own.

Why is it some people are being asked for last 3 years tax returns? (or
is that just unique to a K-1 filing?)

When I filed K-3 for my hubby, atty. said only my most recent tax return
would be sufficient.

Jeff,



My co-sponsor is my friend randy. His W-2 alone is about 350.00 dollars
short, so i want to use his wife's income as well. she had 2 jobs last
year, but can only find 1 of her W2's. The W2 that i do have of hers,
with my friends W2 would be sufficient if the consolute will accept her
1 W2 instead of having to have them both. i hope i am making sense, i
know it is confusing. Tell me this, it is ok to use my friend and his
wife as co-sponsor right?

Hi Maryanne



I think it depends on the consulate. Going through Ankara, their
website doesn't even say tax returns are necessary for a K1. But when I
emailed them to double check what backup I might need to provide for the
I-134, they wrote back 3 years of tax returns, W-2s, and any other
documentation relevant to show proof (employment letter, pay stubs, bank
letter, bank statements). I've got tons of backup!! LOL

Thanks Rene! I was always curious about this because I thouught our
atty. advised us incorrectly, (it seems that everyone is submitting 3
years returns.) I read somewhere (not on this board, but can't remember
where) that it depends on the Consulate the K-1 or K-3 will interview
at.
