The Diversity Visa Program (DV), a Congressionally-mandated annual
program established under the Immigration Act of 1990, began in fiscal
year 1995 (October l, 1994). It is designed to diversify immigration
to the United States by nationality by giving applicants a chance to
immigrate who cannot qualify through the traditional means using a
work or family-based petition.
The program makes 55,000 visa numbers available annually to natives of
countries whose immigration levels over the most recent five years
meet a complex statistical formula, which classifies them as "low
admission states." Once a person is selected in the Diversity Visa
"lottery," he or she must then meet all the normal eligibility
requirements under the law in order to be issued an immigrant visa.
Since some will be unable to meet those eligibility requirements, more
than 55,000 individuals are computer selected to be given the
opportunity to apply. All individuals who are selected are advised
that they should apply early in the fiscal year when visa numbers are
available.
Some years the 55,000 available DV numbers are not used until the last
days of the fiscal year; this year the numbers were used earlier and
at a faster rate than in recent years. This means that applicants who
delayed responding to their letters of invitation for interviews,
postponed their interview date, waited to supply needed documents, or
whose cases mandated additional administrative processing,
unfortunately lost their opportunity to receive a DV because the
numbers have been depleted.
