If one applied for an EAD under category A06, and after 90 days the applica=

Sec. 274a.13(d) Interim employment authorization. The district director sha=
ll adjudicate the application within 90 days from the date of receipt of th=
e application by the INS, except in the case of an initial application for =
employment authorization under =A7 274a.12(c)(8), which is governed by para=
graph (a)(2) of this section, and =A7 274a.12(c)(9) in so far as it is gove=
rned by =A7 =A7 245.13(j) and 245.15(n) of this chapter. Failure to complet=
e the adjudication within 90 days will result in the grant of an employment=
authorization document for a period not to exceed 240 days. Such authoriza=
tion shall be subject to any conditions noted on the employment authorizati=
on document. However, if the director adjudicates the application prior to =
the expiration date of the interim employment authorization and denies the =
individual's employment authorization application, the interim employment a=
uthorization granted under this section shall automatically terminate as of=

Hi:

There is nothing preventing a person from filing a second I-765 with the
adjustment under the C-9 category -- simply disclose the prior A-6
application. If the second 765 is still pending after 90 days, then you
should be able to receive the interim. There is nothing in the
regulations that suggests otherwise.
