Hi:
There is nothing preventing a person from filing a second I-765 with the
adjustment under the C-9 category -- simply disclose the prior A-6
application. If the second 765 is still pending after 90 days, then you
should be able to receive the interim. There is nothing in the
regulations that suggests otherwise.
