Default Interesting situation - Mr.Miller please help

Hi,

I applied for Canadian immigration under skilled migrant category in
Dec 2001.
I got a letter from Buffalo saying my interview has been waived in Feb
2003 and the letter further advised me to do medicals after six
months. I paid ROLF and did my medicals in June 2003. I visited Canada
in June 2003 to see my fiancee at that time who is a Canadian PR.

In December 2003 I got a letter from Buffalo saying that my file has
been transferred to New York and that I should face an interview and
it also said that I will get a letter from New York regarding the
interview date.

I got married in Feb 02 2004 in Sri Lanka and my wife is a Canadian
PR.
Since she is Canadian PR I didn't need to include her in my
application.
But I informed Buffalo about my marriage and hence my change of
marital status and provided all her details by a fax on Feb 17, 2004.

My wife went back to Canada in April 8,2004 and I was planning to join
her after I get my PR.

And I was expecting the interview letter anytime from New York.
And all of a sudden I got a letter from New York dated April 27 saying
that my interview has been waived and asked me to send the passport
visa stamping.

I went in person and got my PR visa stamped.I have time till Dec 2004
to land.
They have given me additional six months because my medical should
expire in June 2004, if u go by the regular one year validity.

My problem is that in the form I got from the New York office, which I
was told I should take along with my passport when landing, my Marital
and Family status has the value of 1. Marital status=1 means, I
understand is "SINGLE".

What I think could have happened is this. By Feb 17, when I faxed the
change of my marital status to Buffalo my file would have been
transferred to New York. The Buffalo office may not have informed the
New York office of change in status details.


I have proof that I have sent them the fax.

What should I do now?
Should I inform New York about this and make the appropriate changes
before land? Or can I inform the immigration officer when I land and
explain what happened.

Mr.Miller and other experts please help!!.

I have another question. I also have a one year multiple entry visa to
Canada which I obtained to visit my wife on holidays till I get my PR
visa.
Can I use that to enter Canada when I also have my PR?

Nothing to worry - simply inform examining officer during landing process
about the situation and show copy of fax you have sent. Your spouse is a
Canadian PR thus there is no need to add her to your application, simple
notification sent with copy of marriage certificate would be enough in such
circumstances. But again - make sure to tell everything during landing
process.

Yes, you may enter Canada as visitor - simply indicate at the port of entry
that you are not landing at this time and entering as visitor only.

Hi Mr.Miller,

Thanks very much for ur advice.
I have one more question. I just need to ask this for my own
satisfaction.

When I faxed the CIC to inform the change of marital status, I did
provide all the necessary details of my wife but didn't send the
Marrriage certificate, although I had it at that time. It didn't occur
to me at that time.And also I was faxing it to notify them but not to
include her in my application.

Is it OK to show the officer in the landing post, the original fax I
sent and my marriage certificate while explaining the whole situation
using the correspondence I had with CIC.

Yes, it will be OK. Just have all documents (including marriage certificate
and proof of your wife's PR status) with you when landing.
