Default Indian Birth Certificate for US Immigration

Hi,
I am in the processing of applying the I140/I485 stage for US
Green Card after a long 3 years wait for labor certificate. Birth
certificate of the applicant and the spouse is required for applying
140/485 stages. We are Indian national.

I have a problem obtaining the Birth certificate for my Wife. She
was born after 1970 and she don't hava a Birth certificate. She was
born @ home and therefore her birth is not registered @ Birth/Death
municiple office. Birth//Death municiple office is not issuing the
Birth certificate since her record is not registered.

What is the alternate procedure for getting the Birth Certificate
that is acceptable to the INS. Please help??

What is the procedure for getting the alternate supporting documents
for Birth certificate. I am from India, Andhra pradesh, hyderabad.

Thanks
Best wishes
Narender

Hi Narender,
I had the same problem . However there is a procedure where by you can
now get her birth regitered for the same date in the native village.
you have to meet the regitering authority and they will give a you a
form which you have to get siughned by the local police station in
your village. then that form along with the form for the local
magistrate will go to the regitering authority.Looks fairly
complicated but is simple and you can ask your brother or father in
your valiiage to get it done. Mine took 3 days total. They will need
affidavits from both the parents and her CBSE certificate would help.
There is not other way USCIS will agree.
Also make sure that all birth certificates yours included /any
children have both thier parents names and the concerend person ( your
name if your certificate)name on the certificate.I had a problem as in
India they dont write name on the crtificate.Hope that helps

Email me if you want.
