Default immigration

hi,
i am 30 yrs old man and my fianceee is 50 yrs
old american!
she plans to come to india and marry mme and
wht shud be best option for us
shud i go to usa on a fiancee visa or call her here
to do the ceremony and then apply for visa
does age factor be determinental for us?
as she can't concieve

You have two choices:

1. She can come to India and marry you, then start the process for your
spouse visa when she returns to the USA.

2. If you have met in person within the past two years, she can start
the fiance visa process now, from the USA. If you haven't met in person
yet, she can come to India to VISIT you (don't get married) and then she
can start the process for your fiance visa when she returns to the USA.

In general, the age factor should not be a problem, although sometimes
it raises more questions on the validity of your relationship,
especially in consulates like India. Just make sure you have plenty of
evidence of your ongoing relationship.

The choice of which visa to apply for is totally up to you guys.

The "best option" is the one that works for you.



You must first decide *where* you want to marry... that will determine
the type of visa that you need.



Age will likely not be a factor... neither will her ability to have
children. In fact, you don't even have to love each other.

Hi,

By law, age shouldn't be a factor but I am sure that if apply for a
fiancee visa or an immigrant visa, the US consular will make his
judgment based on the prevalent culture of the country. I believe that
it'd be very rare that a 39 year old man marry a 50 year old woman in
your culture. The only way to convince him would be to actually marry
in India and have photos to show. I doubt that she will have a chance
for a fiance visa.

My opinion are not based on immigration law but from my knowledge on
how things work in that part of the world. Take it as you may.


If she comes to US on a visit visa and then marry you, well the intent
might be an issue but if she just comes to visit you with plan for
both of you to go back to India but the situation is such that you
can't get away from work and hence you two decided to get married
while she is in US. Who is going to stop you two from getting
married?

But whether she will get a visit visa or not especially if the
consular knows that she has a finace, I am not sure.

Yes, age does make a difference. However if you can prove that your
marriage is not a sham then you should be ok. When you get married, throw a
big party. Invite friends and family and takes lot of pictures... The
immigration officer needs to see them to judge if the marriage is a sham or
not. In India they have 6-7 parties before the actual wedding party. Make
sure you have them all and take pictures in all of them.
