Default I-864 : Currently unemployed but above poverty guidelines...!

Dear Friends..

I want opinion on filing I-864 where the USC has filed regular tax returns and is sufficiently above the prescribed poverty guidelines for 2005.

The USC is currently unemployed because he wanted to live with the spouse in her country till her process is over. So he left the job and went out of USA to live with the spouse.

Now while filing I-864, he has to show himself as currently unemployed ( though he had a job till the last day of his departure ..and he is out for around 5 months now) but he has income above guidelines as per his recent 3 years TR's.

So is it suggested that he goes ahead and files the AOS on his own or include a Household member or a Joint sponsor?

Hoping to get valuable response asap..

As I recall there was an option/requirement to show a lump sum amount equivalent to 5 years of the poverty threshold amount for your family size.

Just borrow the money (roughly $80,000) on a short term loan, stick it in your account, print a statement and pay it back - shazam, you qualify.

As for the job, just get a temp job at McDonalds, get your employment letter and use that.

Easy option is to use a sponsor in the US, that's really what they want you to do.

These requirements are easy to circumnavigate, and the Embassy official spends all of 10 seconds verifying them.
