Default I-751 When Separated

Hi I am starting to panic a little as my 2 year anniversary approaches and am hoping that someone can help me.

I separated from my husband after he got violent. I was never battered, because I got out before it came to that. He was an extremely controlling and cruel man, and we were not safe.

But knowing what he is like, I do not believe he will give me permission to take our daughter (2 years old, who he hasn't seen since she was 6 months old and has said that he doesn't want her) back to the UK with me. So I currently believe that the best thing for me is to try and extend my GC.

But how do I apply for the waiver? Or rather, on what grounds?

You see we are not divorced, only separated. I cannot afford to start a divorce, and he won't either because he doesn't want to spend the money. The marriage ended because of cruelty, but how do I prove that?
