Sorry to hear
that they've lost your I-212 and you will have to refile. In addition
to a statement from you on hardships you would face if he were not
allowed to return, make sure you that your husband includes a statement
on why it would be a hardship to him as well.
They also want to know:
- if he has ever been arrested or convicted either in his country or in
the U.S. If he has no criminal record, make sure he states that in his
letter and include a copy of a police certificate if you have one.

Letters of Character reference showing he's a person of good moral
character.
- If he was ever employed in the U.S. and if so, if it was
authorized.
- Hardships to any other family members, your parents,
siblings, etc.
We are also waiting for our I-212 and received an RFE
for the above items.
If you could provide any documentary evidence on
any of the hardship factors in your statement, that is ideal, such as
letters from doctors or employers.
Finally, are you working with a
lawyer? In cases such as these, it is highly recommended since these
cases can be complex and you want to make sure you have all your bases
covered. A simple submission of a hardship letter is not generally
enough.
