Default I-212 Approved today

For those of you going through the i-212 process,
I just learned today
that my i-212 has been approved. I'm not sure exactly what this means;
tomorrow i'll check with our attorney, but I'm hoping the next step is
the last step: going to the consulate for a second interview and visa.

For your information, my I-212 took about 6 months, submitted in August
of last year. The whole process has been nearly 2 years!

Timeline

July 2002: I-130 submitted
August 2002: K-3 application submitted

January 2003: K-3 Approved and forwarded to consulate
July 2003:
Consulate interview, visa denied, (I-212 requested)
August 2003: I-212
submitted
September 2003: I-130 Approved and forwarded to Consulate

Today (February 19, 2004): I-212 approved
Now waiting for a second
consulate interview, to present approved I-212 and hopefully get visa.

Thanks to all the supporters over the past two years!

Congratulation on i-212 approval drvics!!!
You are almost done...
There is some hope for my husband to come back... Our lawyer filed
i-212 in July 2001 with Dallas INS and nothing ever happend. My
husband is about to re-file it at the Consulate ( per thier request ).
So, 3 year of wait were waisted:(.
Just one question I have for you: with i-212 form, did you attach any
docs besides a "Hardship Letter?".

Sorry to hear
that they've lost your I-212 and you will have to refile. In addition
to a statement from you on hardships you would face if he were not
allowed to return, make sure you that your husband includes a statement
on why it would be a hardship to him as well.

They also want to know:

- if he has ever been arrested or convicted either in his country or in
the U.S. If he has no criminal record, make sure he states that in his
letter and include a copy of a police certificate if you have one.

-
Letters of Character reference showing he's a person of good moral
character.

- If he was ever employed in the U.S. and if so, if it was
authorized.

- Hardships to any other family members, your parents,
siblings, etc.

We are also waiting for our I-212 and received an RFE
for the above items.

If you could provide any documentary evidence on
any of the hardship factors in your statement, that is ideal, such as
letters from doctors or employers.

Finally, are you working with a
lawyer? In cases such as these, it is highly recommended since these
cases can be complex and you want to make sure you have all your bases
covered. A simple submission of a hardship letter is not generally
enough.

Yes, I agree with GMS's great suggestions. I did all that. In
addition, my hardship letter included a detailed explanation about what
happened that caused the deportation. We explained how we did not
intend to break any laws and how we are very sorry. I suggest your
letter be very straightforward and sincere. Also, I assume the
consulate will give you something in writing that says that all the
background checks and other processes are done and all that is left for
further consideration and processing is the approval of the I-212. That
is what our consulate wrote in an email, and my attorney summarized this
in the cover letter. Of course, the consulate can't say that they will
give you the visa automatically after the i-212, but all they have to
suggest is that they are looking favorably at the case so far and that
they need the i-212 to move forward. Finally, I agree having an
attorney is a plus. He/she should not be expensive, as the amount of
work is not much.
Good luck!! I know how frustrating it is to be so
delayed. But do hang in there. And of course, pm me if you think I

Well, in our case, we went ahead with our case at that point as if no 212 was
needed. Husband filled out the packet 3, got an appointment at the embassy and
was issued the visa.

drvics,

Thanks so much for your reply. I felt like our attorney did not know
what he was doing. The hardship letter was the only document attached
to our i-212 in 2001. Besides, every time I called him (an attorney),
he was just more and more irritated as if he was doing me a favor
talking about the status of the case. The only advise he had was to
wait...
This time around, I am going to re-use the hardship letter from 2001 (
with fresh dates on it ), and then we will follow you suggestion and
have an explanation letter from my husband about events that caused
his deportation.
He said that an American lady @ Consulate seams to be very polite and
understanding. I will tell him to make sure she forwards her
recommendation to approve his waivers along with info about completed
background check.
