Default How Long Does It Take...!!:o(

Hey Everyone...!!!
I just had a question..!! I came to the USA to visit my fiance (who now is my husband) about 6 months ago..! I had no plan to stay this long...but my fiance (again who is now my husband) and I could not live without one another anymore...so we got married in Aug...! We talked to a lawyer previously before we got married and he said that after we get married I will get my paper so my husband and I can go visit my family out of the USA...! He still has not sent the papers for the greencard or the paper for me to leave and everything UNTIL today..! So..I was wondering...how long approx does it take..!!! And I wanted to know if it is seriously legal for me to live here while this is going on because my lawyer said it is...but I want more info..! I don't want to do anything wrong because I'm just not that type of person...!!! I just hope we are doing everything right because we are so in love and there is no way I could be away from my husband..!!!! Is it even legal for my husband and I to like go home and see my family for christmas then come back...that being if my papers don't come..!! I would appreciate any info..!Thanks everyone..!!!!!
PS---> I ramble so I hope I'm making sense to everyone...hahah..!!!

Hi Lilly,

From the time the I-131 for your AP (travel document) is filed, it takes
about 60 days to receive the AP in the mail....which means you won't
make it in time for this holiday season.

It's legal for you to remain in the USA once your AOS paperwork is all
filed and accepted at USCIS.

If you leave the USA without your AP in hand, you will not be able to
return to the USA. You would have to start immigrant visa processing at
that point. Your husband, if he is a USC, can come and go freely.

Why did your lawyer take so long before filing? My wife and I got
married in August last year, we filed 2 weeks later in Sept, and in
November I received my AP in the mail well in time before the holidays.

As Noorah said, your chances of getting the AP before the holidays are
close to zilch. You can always try to arrange for an emergency travel
document, but these are normally only granted for severe hardship such
as a seriously ill relative, births and christenings, funerals, etc, so
don't think that option applies.

Another issue is how long did you exactly overstay your visit? If you
have 180 days or more of overstay (you can check that date with the I94
in your passport), you shouldn't apply for an AP or try to use it if
you get one. I assume that if your lawyer is anywhere competent, he has
checked this and applied for AP only if you are safely inside the 180
days. The counter for overstay stops when the USCIS receives your AOS
papers.

Other than that, your stay here is perfectly legal provided there are
no complicating issues, although I wouldn't have taken so much 'risk'
waiting so long between the marriage and the filing as you don't have
any official status or documents to fall back onto.
