Default How fast will she get the papers?

Hi everyone!

Hopefully, soon I will be getting my residence card!

How long will it take for BCIS to give a social security and a work
permit to my girlfriend after we marry?

I know that for a person that is a citizen, it usually takes six
months? -- now I wonder how long will it take with a newly resident.

I would appreciate any comments.

About 4 years and a bit.

She will need to maintain legal status by other means meanwhile.

She is illegal at the moment. She is going to a community college and
paying her own education...hopefully in four years she will graduate
from college just in time to work. What happens if she gets deported
while waiting for her social? Can she come back after four years?

If she doesn't have a social security number or a work permit, how
exactly is she able to attend school and pay for it?

RUN, don't walk, and consult a friendly immigration attorney today!

Honestly, they don't bite.

Well, Mr. F. sometimes does, but we keep him well fed (even though it
does say "Do NOT feed the lawyers" on the enclosure)...

(please don't hurt me!)

Looks like you guys are possibly in deeper doo-doo than you think. Go
consult a legal professional. They tend to know more about this stuff
that the rest of us who've gone through the process by the book...

Kind of an important detail to leave out of your first post, don't
you think?

Not only that, but you don't say HOW she became illegal. Did she sneak
across the border? Did she originally enter the US on a valid visa which
is now expired??

If she's here illegally then that's a MAJOR problem far beyond what an
internet newsgroup can handle. She needs LEGAL help.

Legal help will not help anytime soon.

The OP has by the sound of it just got his GC, so 4 year wait, give or
take, for a permanent resident to petition for a spouse.

He could wait for Citizenship but that would be 5 years plus, on the
reasonable assumption that he did not get his GC through marriage.

If his fiancee did enter with inspection, and she kept low until he got
his Citizenship, the she could stay and adjust.

Otherwise she will need to return home once his spousal visa application
is current and go through the waiver process to get back in.

Mind you in that time frame there could be an amnesty in which case
who cares.

If you want to read about the waivers, have a look on
www.immigrate2us.net, there is a lawyer who contributes there, Laura
Scott, and who seems well regarded in this area.

She would be deportable, all other things being equal, marriage to you
will not change that.

Why are you guys so concerned about her financial status?
She gets the money by WORKING as an illegal immigrant.

She came to the US with a VISA but it is now expired.

Also, why does it matter how I get my permanent residence? I don't
understand. For the record, I am waiting for my permanent residence
after I was granted political asylum.


All I wanted to know is if we get married before I get the permanent
residence and while waiting for the interview, which some say it will
take four years, what happens if she gets deported?

idea?
