Default How can I back to US after Landing.....

I post a similiar question two days ago, no postive answer show up.
I
have an ongoing project to finish at NY. But have to land this spring.
Someone please tell me
1. How can I get back to US after Landing? Do I
need to get a US-visa stamp from Canada? Can I back to US within 30 days
without that Visa?
2. If I drive my car or a rental car, Do I need to
tell the officer I will back to US in 10 days at the landing time, and
to get a permit to avoid the car importing procedure?
Really need you
help and thanks lot!

Jag

I could not find a document that clearly states that you can do it but
here is an implicit hint:
http://travel.state.gov/exclusionvisa.html
I may be in a similar situation once I get my Canadian visa. I plan to
apply for a new visa while in Canada just in case.

I believe as long as you cross by land (private vehicle) and retain your
existing valid I-94, you can return without a new visa stamp.
Another requirement is that your current status should be the same as the
expired visa stamp on your passport.
What that links you sent says is that *if* you apply for a visa *and* you
are denied, *then* you cannot come back.
It does not say anything about retaining the I-94 and not applying for the
visa at all.
Also, it applies mostly to the countries in that special list.

You can enter US as long as you have a "Valid Current Visa". Entry is
not permitted solely on the basis of I-94. I'm on H1 and travel almost
daily between Windsor and Detroit.
If you take your car you "MUST"
import the car, the officer would not allow you to enter Canada without
importing. If you want to avoid the import, your best bet is to take a
rental, tell the officer that you will drop off the car at an airport
etc.
As for getting back to US, you don't have to tell anybody, for
all you want you could drive straight back once all formalities are
done with immigration. Once your landing is done you could re-enter
Canada based on the landing permit even without a PR card but this can
only be done from US on a non commercial carrier.
Make sure you have
a current address in Canada before you start, you'll need this for the
PR card and SIN.

Are you absolutely 100% certain that it is not possible to enter the US
using a valid I-94?
The reason I am asking this again is because a couple of months back there
was a long thread in this group regarding the same issue and a couple of
people said that they have returned using a valid I-94 and an expired visa
stamp.
I also searched in the alt.visa.us group and several people there have done
the same.
Also the experts on that group (Ingo and Sylvia) clearly stated that it is
still possible to return on the basis of valid I-94 *as long as you are not
a citizen of one of the listed countries*.

I am not doubting your experience - just asking whether you are certain that
it is not possible.
Have you yourself tried doing it anytime and been refused entry?

Thanks.

I did the same thing in Aug. 2001, visit Canada with a friend and re-
entry US with my valid I-94 card at Niagara Falls. But I am not
absolutely 100% sure whether I can do it at this time. Is the 30 days
grace period still available?

Is there anyone did it this year?
Thanks!

Thanks lot you all!
I still have a question:
My H1 based us-visa already
expired years ago, but my I-94 card still valid, is that means I don't
have a "Valid Current Visa"? And do I need to apply a visa in Canada in
order to back to US?

Need more advice and Thank you so much!
Jag

Jag --

August 2001 is the pre-9/11 days.
As we know, everything turned around after that date.

Most of the new stringent regulations on border crossing and entry into the
US were put into place during the Jan 2002 - Sep 2002 timeframe.

Hi,

What exactly is landing permit and is this something that we get
explicitly when we land in Canada? Or do we have to apply for it?

thx,
Singh

you're right! It is before 9/11. Since I know lots of things turned
around after that date, I really need some suggestion regarding the
current situation before I land in Canada.

Again thank you very much!
