Default help on h1 transfer

I had my h1 approved. The date on my NOA is Dec8. Im suppose to start
working for the company who sponsored my visa on may 1.

However company B who is a client of the company I'm working with in
my home country is willing to sponsor me too. I've been working on
their projects for more than 2 years now and I want to join them
instead company A. I know I should have let CompanyB process my h1
from the beginning but I didn't know about the opportunity because I
didn't let my present employer(home country know about my plans until
I got the approval.

I have a 2 year contract with Company A but I'm willing to pay the
amount we agreed on if I can't complete the 2 year contract. I want to
do a transfe instead of filing a new h1 coz think it's faster and I
don't have to go back to my home country to process that.

Can I transfer my h1 to Company B immediately, let's say.. after a
month Because all I need from CompanyA is paystub right? How many
paystubs do I need to show them. I'll be paid bi-monthly. Would 2
paystubs(1 month) suffice?

I'm a Programmer/Analyst. The position with CompanyA and CompanyB will
be the same. However I'll be an in-house developer with CompanyA which
business is far from Information Technology while CompanyB is really
an Information Technology firm. What is the probability of denial
considering those including the fact that I only worked for CompanyA
for a month. Would it be a problem?

Can CompanyB file the LCA before my first month so that they can file
the transfer immediately after I get my pay stubs? Coz it also takes
1-2 weeks for the LCA and we don't want to waste time.

Any help would be greatly appreciated.

Company B could file the H-1B as a second concurrent H-1B. That way, you
won't be affected by the quota.

Don't worry about the pay stubs in this case. They are only important when
you are already working for company A.

Do note that this would not be a transfer, so you would have to wait
outside the USA for B's approval.

Also, keep in mind that A went through quite a bit of expense for you, and
while it is perfectly legal to change your mind, there is also a bit of
ethics involved here.

Would it be ok to file a second concurrent h1 since I already have my
first h1 application approved?

Even if I wait on my home country for
the processing of my second h1 (Company B), I would also have to pay
CompanyA $10000 because that's what I signed on our contract if I don't
stay with them for 2 years. So I'm wondering if transfer is easier, if
it's possible and if it wouldn't be too risky if I only have to work
with Company A for a month.

It's not technically a transfer because you haven't been working for A
yet. But a concurrent H-1B should be doable here, unless A withdraws the
original petition.

How soon can I work with Company B? Can I work with B as soon as they
files my h1 and get the receipt from INS? Is concurrent h1 ok even if
the two employers are from different states (company A in Florida, and
Company B in California)? Approximately, how long is the processing for
concurrent h1? So while waiting till I can work with B, I can work with
A for the mean time? Do I need to go back to my home country for the
visa stamping when my h1 for B is approved?

Concurrent H-1B is OK no matter where the employers are located.

You cannot start working for B until that H-1B is approved with this
approach.

Starting to work for A is definitely legal because you have your H-1B
petition for them. It is a bit dicey only because USCIS (INS no longer
exists) might argue that you don't actually intend to work for A, but
rather are really waiting for B's approval. But if you do get a paycheck
from A, they would have a hard time with this line of reasoning...

If you start working for A, and B files the new H-1B after you started
with A, then this would become a classical transfer case, and you could
start working for B immediately. If B files the H-1B before you start
working for A, you should wait for the approval before starting to work
for B (although one could argue that it would still be a transfer in that
case, this sounds like a dicey position).

How long it will take is very difficult to predict right now. If B pays
the $1000 premium processing fee, it's likely to be 15 days or so. If they
don't, it could be very slow (because USCIS would prioritize new H-1Bs
right now, due to the quota), or it could be very fast (if USCIS has
already finished with all the quota H-1Bs).

You will *not* need to return to your home country for stamping. Your H-1B
visa stamp is not specific to the employer (it does list the employer, but
for informational purposes only).

Two weeks should be plenty to establish genuine employment with A in the
eyes of USCIS. I don't think there will be a problem.
