I just discovered this forum and hope I'm posting in the right place....
First some quick background info: My wife and I were married this past
June. She is from China and originally came to the US for school. She
came here with a tourist visa first so she could experience the US
before committing to school. When she decided to stay she naturally got
a student visa(F).
Fast forward to 2003. Her visa and OPT expired 2 months after we got
married (August). Right around that time we went to the INS office and
applied for her work authorization, AOS and AP so we can visit her
family next month. She received her work authorization and AP documents
very quickly to our amazement. Anyway, the point of this is, how
difficult is it to come back into the country with AP? I see on the INS
website how people with AP can be denied and their AOS completely
ruined. And the stuff about 180 days or more of unlawful status? Very
confusing. Per the info stated above she has always been legit. I know
I am being overly paranoid, but I'd love to hear from someone with
experience in this sort of thing.
Also, on her AP travel document and EAD card her name is printed as her
Chinese name followed by my last name. On a side note, they spelled my
last name wrong on the AP so we had to go back to correct it. When they
mailed the new AP document they spelled my last name wrong...again! So
we are going back a third time. Unbelievable!
Someone at the office said because her Chinese passport only has her
Chinese name (we weren't married at the time she got that obviously) we
may have a problem if it doesn't match the AP document 100% I find this
hard to believe but it still makes me a bit nervous. We then called INS
twice to ask about this, and got a different answer each time! One agent
said it has to match, the other said just bring a marriage certificate
and it will be no problem. If anyone can shed some light on this it
would be greatly appreciated! Thanks
