Default H4 Visa Questions

Hi I need help from the forum.

I am on H4 VISA which will expire on March 07. Right now I am out of
USA and my husband is in US and he is trying to extend H1. Lawyers
told him we cannot apply H4 extension since I am out of USA. If his
H1 approve then can I get my H4 Visa extension through US embassy from
my country.

Please send me your suggestions.

The way I see it, you could 1) Return to the USA before your H4
expires; or, 2) Wait outside the USA to see what happens with your
husband's H1 extension. If it gets approved, you can extend yours. If
not, you and your husband will have to deal with those results.

1 Lawyer is correct H4 extension can be filed if you are in US

2 if his H1 gets approved then your spouse need to send you his H1
approval notice, copy of the full petition that was filed with USCIS
and employer letter ,copy of his pay stubs, copy of his W-2 (US
consulate can ask any document and provide what is asked) and you can
get H4 visa stamp till his H1 extension from US consulate.

3 If his H1 gets approved BEFORE your present H4 visa stamp expires and
you want to come to US before your current H4 visa expires then at POE
show the valid H4 visa stamp and your spouse H1 approval notice and you
will get I-94 till your spouse H1 approval notice.
