If past policies are any indication, then it will *not* make a
difference. USCIS at some point announced that any application filed
prior to a particular date would be approvable under the cap, and any
application filed later would be denied (or rather, the employer would
be given the option to wait until October 1, 2006). As far as I recall,
they also refunded the Premium Processing fee for such cases.
Last year, they actually screwed up. The cutoff date is based on
guesswork, and they guessed so wrong that they actually approved about
10k more H-1Bs than they should have. If they had been guessing wrong in
the opposite way, they probably would have approved cases filed after
the cutoff date on a first-come, first-serve basis.
