1) I am in India right now and not in US so I want to just



make sure of rules before I begin my H1 Processing. As u had



said about the 6 yrs of H1 to be avaialble again if I have



spent one year outside US after the first H1 of 3 yrs. So can



that one year of stay also include the period in which my



first H1 was valid.

My case is I have come back to India after staying two yrs in



US so I had still around 10 months of Visa vaild when I came



here. Now today if I start for a new H1 before the old H1



expires but when I go for Visa stamping I have already stayed



one whole year outside US. So does that give me a H1 which can



be again valid for 6 yrs ???

Does my periods within my H1 been valid also get counted if I



have stayed outside US??



2) For H1 Transfer Do I have to be in US??

3) And for H1 renewal, do I have to have the recent pay



stubs?? In my case I have come back 10 months ago to India



and dont have recent paystaubs but my employer is now ready to



renewe my H1 and look for a project now. How can he go about



it??
