Green Card interview in Warsaw
Hi Everyone,
Maybe somebody knows and can share his/her experience... I am a little
nervous about the interview. I got the appointment package from the
American Embassy in Warsaw, all papers in Polish, fortunately I found
the same information on their web site in English and could read it.
What bothers me is that it says in the papers that I have to bring
with me the Affidavit of Support (I-864) and all supporting
documentation, also it says that the visa fee is $335... But my
husband has already submitted the Affidavit of Support, bank and
employment letters, taxes, etc and also paid this $335 fee for the
visa processing to the National Visa Center in the USA. Then the NVC
forwarded everything to the American Embassy in Warsaw, which
processes immigrant visas for Ukraine. I hope I will not have to show
them the same papers and pay this fee again (we just don't have
enough time left to prepare the Affidavit of Support)... I tried to
contact Warsaw, but neither me no my husband could get through, and
when you e-mail them, they reply in 10 days, not earlier.
Has anyone been in a similar situation and knows which documents I
need for this interview?

The I-864 is needed for the interview. It should not have been sent with
the I-130 petition. You will need it and the supporting financial
documents. You will pay the visa application fee, which is separate
from the I-130 petion fees. Additionally, you will also have to pay for
a medical exam.
Your husband would have paid $130 to file form I-130.
The $335 visa fee is in addition to the fee for filing the I-130.

I had this issue at the London, UK embassy. Although, the embassy sent me
out of date paperwork telling me to bring the Affidavit and fee, the NVC had
already requested both. Like you I panicked a bit. I sent an email to the
embassy, and they mailed me back saying that they had already got them from
the NVC.
I don't think you have a problem at all.
However, I suggest you take copies of the affidavit with you. Also, if
another tax filing deadline has passed since you applied, I also suggest you
take your sponsors most recent tax returns - I got asked for them, but as I
didn't have them, they weren't too bothered ... I got the visa!

Thanks a lot for reassuring me! I have some original supporting
documentation with me, like taxes for 2000, 2001, 2002 (this is what
they required), bank letter, his retirement plan, copies of the house
deed and mortgage note, etc and also original I-134, notarized. My
husband sent me all these papers in August last year. I only don't
have his new employment letter ( he changed his job) and this new form
I-864. If he has a copy of it, I'll ask him to send it to me by e-mail
together with the copy of the new employment letter.
One more question, did you have to show the proof of your marriage at
the interview?

Email isn't going to help. They need the original signed and notarized
I-864. Additionally, he would not have paid the immigrant visa
application fee when he filed the I-130. He paid the I-130 petition fee.
You will need the money as listed on the Warsaw web page.

Dear Julia,
I guess I will not be able to give you an advice, I can only
tell you my situation. The reason why i am writing you is the fact that
I am going to Warsaw, too at the end of the March and this is the first
time I see smbd. going to Warsaw like you do. I am from Latvia, my
husband and I we got married in my home country, we also filed I-130
here at the embassy and as far as I know, we will have to pay the $335
once we arrive at the embassy in Warsaw.
Just wanted to wish you good
luck. don't know when exactly are you going to Warsaw, but in case you
go before us (March 25), maybe you could give us a little message on
that how is the atmosphere and procedures in Warsaw. We would be very
very thankful.
Wishing you best of luck and hope you guys have no
problems with the documents.

I feel for you ... I know what it's like going through this process ... it
*will* soon be over and you'll be with your man!
I'm not too sure of your precise situation, and your most recent post
confused me a little.
First of all let's see if me describing what happened with me helps.
* My wife is a USC.
* She applied for an immigrant visa (I-130) for me. As this takes a long,
long time ...
* She applied for a non-immigrant visa (K-3) - that let's you live in the US
temporarily!
* The I-134 (affidavit) is for a non-immigrant visa, which I took to the
non-immigrant visa interview, when I got my K-3.
* A few months after I got my K-3 (non-immigrant) visa, we got a request
from the NVC for the I-864 (a different affidavit for the immigrant visa)
and fee.
* Then I got called to the embassy for my immigrant interview (they asked me
to bring the I-864 and fee). As I had already submitted the I-864 to the
NVC I couldn't bring it with me, and indeed they had it when I went to the
embassy.
The key things are:
* I-864 for an immigrant visa (I-864 & I-130)
* I-134 for a non-immigrant visa (I-134 & K-1/K-3)
So depending on your situation, there may be one or two *different*
affidavits involved.
My guess remains that you are okay. I say this because one of the reasons
that the NVC gets the affidavit from you before the immigrant visa interview
is to ensure that the paperwork is correct. The embassy (despite asking you
to bring the affidavit with you - see my previous post about using old
paperwork) isn't going to be able to invite you for interview until the NVC
have okayed the affidavit (I-864) and passed it on to them for processing.
Do remember that the filing date for taxes is April 15, and so, having a
copy of your fella's taxes for 2003 (or a copy of his request to file late)
might be useful - but don't panic if you can't get it.

mtravelkay I must disagree with you.
Although what you say, is the system that used to be in place, what Julia
says is exactly what happened to me ... I am now in the US BTW!
Whether this new way of operating has been implimented in all countries I
don't know, but it was certainly the case in the UK last year, and appears
identical to the situation taht Julia describes.
The process that I experienced was:
* I-130 application + fee
* Subsequent request from NVC telling me that they had changed the process
and asking for affidavit (I-864) and visa fee.
* Later invitation to embassy for interview (requesting that I bring the fee
and affidavit).
* [Email exchange with embassy, where they confirmed that they had the
affidavit and fee and that the request to bring them with me was incorrect]
* Embassy interview (where I saw the affidavit in my file!!!).
* Visa issuance.

You help me a lot! I'll explain you our situation in short. My husband
applied for a K-3 (spouse's visa) and then applied for an immigrant
visa for me (filed I-130). We thought that we would get approved with
K-3 quite fast, I'll be able to come to the US and wait for my
immigramt visa. But somehow we got the immigrant visa approval much
earlier than K-3. Actually K-3 approval came in the mail only about a
month ago.
When my husband applied for K-3 back in June, 2003, he prepared all
the papers for it and sent them to me immediately. That's why I have
taxes for 2000, 2001, 2002, his bank and employment letters and I-134
notarized...
Here is our timeline for the immigrant visa:
1) I-130 1st NOA received from VSC on 6/30, 2003
2) I-130 Approval 10/10/2003
3) Choice of Agent form was sent on 11/07/03
4) Fee request was received from NVC on 12/05/03
$335+$65 money order was sent to NVC on 12/08/03
5) Form Authorization for Release of Federal Tax Data
and I-864 received on 01/03/04 and sent immediately
6) Form DS-230 Part I was received on 01/12/04 and sent the same day
7) Appointment package from Warsaw was received on March 1st,
interview is scheduled on March 23.
I hope everything will be ok, if the American Embassy did not get my
husband's Affidavit of Support from the NVC, then I guess I'll have to
stay longer in Warsaw and wait for my husband to send me the necessary
papers...
We both try to call Warsaw, but no luck :(
My husband could get through to the NVC and here what he wrote me
back:
"I spoke with NVC, and they said they would send to
Warsaw an email indicating we are paid in full for the
visa ($335)..... I said that
Warsaw consulate and NVC are both part of US State
Department, and why doesn't NVC know what Warsaw would
require for financial proof, if NVC authorized our
financial statement and approved us and forwarded to
Warsaw
They said my question was good - that Warsaw shouldn't
and won't require any more information for financials
- unless our I-864 isn't current - and then they may
only ask for recent IRS transcripts - well, our stuff
is current with latest tax transcripts and letters and
stuff
I mentioned to NVC that she didn't sound very sure of
her statements regarding Warsaw, and she didn't
respond... I asked her again, that both Warsaw and NVC
are part of the same State Department, and why would
there be any confusion about my questions... she
didn't respond... "

I arrive to Warsaw on March 22 and have a return ticket on March 24.
After the interview I'll find some internet cafe and write how
everything went. I'm staying at "Hotel Grand Warszawa", which is
within the walking distance from the Embassy (about 10 min walk) and
also it is close to the city center. So, if you didn't find a hotel
where to stay yet, I can advise you this one.

Okay, now I understand better. Your situation is basically the same as mine
was, except it the speed of the two tracks of visa was different, and your
confusion over the instruction to bring the affidavit with you is identical
to my confusion 9 months ago!
Reading your post, everything looks good. The NVC have the visa fee, and
the I-864 (immigrant) affidavit, so if the embassy are asking for these,
they are either incorrect (as they will be sent to the embassy from the NVC)
or (more likely) they are using out of date paper work.
