Didi, for Rhode Island, the service center your fiance will send the
petition off to is the Vermont Serv Center. It should be approved there
within 2-3 months. And then I'd say it'll take at least another 2 months
to get your interview at the US French consulate. This is just a rough
guess, no one ever knows just how fast or slow processing will be. But
as others said, the visa is good for 6 months.
After marriage here, you must apply for what's called Advance Parole
before leaving the US. You apply for this usually at the same time as
you file the I-485 forms to adjust your status. If you leave without
Advance Parole being approved, then when you try to enter the
country, you will be denied and sent back to France. There you would
have to wait for your husband to apply for a K3 visa to get you back
into the country.
It is generally taking about 2-3 months to process Advance Parole (from
what I've seen at most centers) so even if you get married in June, you
more than likely won't have your Advance Parole documents before your
brother's wedding. Thus, you would be better off waiting til after your
bro's wedding to enter the US, if you do not want to chance being
separated from your new hubby for several months.
This is a concern for us as well, since my fiance's sister is getting
married next October, and I want him to be able to attend it, so we are
going to apply for the AP and hope it comes through in time. If it
doesn't, I don't think we'll go.
