Filing for AOS from H1B - AP/EAD and waiting times?
I am currently on H1B and recently married to USC. Having read
through this forum and got replies to my posts I had decided to file
I485 but not file for EAD or AP as I was hoping to save some money,
and keep travelling on my H1B.
My H1B expires on Dec 31 2004. If I file I485 in February, current
Los Angeles Office processing for I485 is saying January 13, 2003. So
that tells me that it will take a year to get interview (at least).
In that case I would have to apply for EAD/AP by end of Dec 2004
anyway (or renew my H1B - which would not make sense). Is there any
likelihood that processing times will speed up and I will get my
interview by end of 2004?
If not it seems to me that I should just apply for EAD and AP now
(since I won't save money in the long run) and travel on my H1B while
I await EAD/AP (current times seem like 3 months or so).
Re: Filing for AOS from H1B - AP/EAD and waiting times?
Yes, I did the same. I'm here on H1-B, married to a USC and in process
of adjusting the status. I applied for both EAD and AP.
You've got
nothing to lose (well, except for $ for those forms but EAD and AP will
come handy).
