My girlfriend is a U.S Citizen and I am Canadian, we plan to get married in Toronto and live here as well. The problem is my girlfriend has a criminal record (albeit just one offense). Can she still apply for residency or Canadian citizenship and be approved?

Anyone can apply the issue is will she be found inadmissable for the conviction. It depends on the conviction and when it happened. You would have to equate it to Canadian Law and not knowing the details makes it hard to say one way or the other.

I know that Canada will not let you in if you have a DWI (or DUI). If you *do* have a DUI and it's been 5 years since you've made restitution for it (fine or jail time) you can get an application from your local Canadian Embassy in the states and get cleared in order to enter Canada.

I know this because my American friend recently got turned away at the Canadian border because they have a DUI in America. In surfing the immigration websites I came across the above info.

I don't know how long it would take to get cleared.

They don't mention about any other offence so I would search the Canadian Immigration website and find out.

It will be harder, depending on the crime. Canada will give a US citizen like they will to someone who is British citizenship even with a criminal record. I would impregnate her, and have a child together. Get married, and after she gives birth, Canada will give her her Citizenship. By the way, you can also be a Yank while you are at it. US does not treat Canadians the same as Mexicans, so rest assured you will not have not nearly as much trouble for becoming american than if you were a Mexican.
