hi phil

i am appliying on a aus
sponsored skilled visa, i have to be primary applicant as my auntie is
sponsoring us, as i am only a student nurse i have no skills to be
assessed, but we have enough points anyway just using my partners skills
as he has a 50 point occupation and he is also under 30, as well as
english lang. So we can get 115 points just from that. you only need
110 for aussy sponsered.

if you are the one with the skill and you have
enough points just to use your skill, then you dont need to get your
wifes assessed???

what is your situation, as its hard to advise
without knowing???

We went for Skilled
Designated Area Sponsored Class BQ Subclass 139 If this is the same
as u then I will be able to help.....pm me if this is the same visa u r
goin for

looks
like u r using a different visa class to ours.... we r looking at a
138 - Australian Linked.....

Hi Laura

thanks for the reply.... as they say.... "every
little helps"....

it sounds like u r applying under a 138 class too...
and the fact that u can use ur spouses skills without requiring your own
assessing is very encouraging.... that way I guess I can use my skills
on her application which entitles us to use her sister as a sponsor
etc..

Seems to get quite complicated

Like I said originally....we are going to apply under the 138 subclass
too. I don't qualify for a skills assesment, yet my hubs does. I have
parents out there, my hubs doesn't. I am going to be the main applicant
on all forms, its the only way to have my parents sponsor us. We will
use his skills from the assesment to get us the 60 points.

If you read
booklet 6 carefully, under the information about the 138 visa, it tells
you that the person who is sponsored HAS to be the main applicant, but
the skills will be assesed of a partner etc...

Get your partner to fill
it in and use your skills.

Hi Phil
That's definitely not the case. The primary applicant for skilled
sponsored does not have to be skill assessed if the spouse meets the
criteria.

So you can contribute your skills for the basic requirements and all the
points except for the 15 points sponsorship, which your wife can
provide. She would only need to be skill assessed if you needed the
spouse skill points.

I usually don't post directly from the Regulations, but will do in this
case. The clauses from Schedule 2 deal with the basic requirements for
skill (on the Skilled Australian Sponsored visa, subclass 138):

138.217 If the applicant does not satisfy the criteria in clauses
138.214, 138.215 and 138.216 but it appears, on the basis of the
information provided in the application, that the applicant will satisfy
the criterion specified in clause 138.225 if regulation 2.27A applies,
the applicant's spouse is an applicant for a Subclass 138 visa who
satisfies the criteria in clauses 138.214, 138.215 and 138.216.

and

138.228 If the applicant does not satisfy the criteria in clauses
138.223, 138.224, 138.226 and 138.227:
(a) the applicant satisfies the criterion specified in clause 138.225
because of regulation 2.27A; and
(b) the applicant's spouse:
(i) continues to satisfy the criteria in each of clauses 138.214,
138.215 and 138.216; and
(ii) satisfies the criteria in clauses 138.223, 138.224, 138.225A,
138.225B, 138.226 and 138.227.

Phil,

My wife and I are hopefully applying for the sponsored visa. we
have friends in Cairns who are going to be our assurance of support,
and my uncle will be our sponsor.

My question is, what commitments
would my uncle have to back us for or is it just the "Family" sponsor
bit that he has to do as we will have friends for our assurance of
support ?

I have had a look at the forms but am still a little unsure
of my uncles obligations. He is a little concerened due to his age
(75). Its just the thought of his obligations if things went wrong and
the pressure that it would put him.

This is an oldie, but I am hoping someone who wrote on this thread is
still around and can help -
When you completed the 47sk, and got to question 54 - 'what is your
nominated occupation' etc, did you just leave this part blank? and
proceed to question 57 - for your spouse to fill in their nominated
occupation and skills?
