ENS Subclass 121 questions
Hi,
I am living in Adelaide and have a friend staying with me just now who
will be lodging an ENS subclass 121 applicaion soon.
He has the following questions which he would like answered. Any help
would be gratefully received.
Thanks in advance.
1. Whilst working in Australia using an empoyee sponsored visa, can I
apply for a working visa non-sponsored in my own right?
2. Whilst working under a sponsored visa, can I undertake contract work
for other employees in the same professional field?
3. Whilst working under a sponsored visa, can I undertake a directorship
with the company that sponsored me or any other company?

Hi there, not 100% sure on this but I'd say you have to carry out your 3
years commitment to sponsor and thereby current job, if you want a
promotion I think this would be fine however I don't think you could
apply for jobs elsewhere without being in breach of visa conditions.
Have a read through your visa - it says on ours and we're RSMS which is
similar to ENS.

1. What exactly do you mean?
1/1. Secondary employment is normally forbidden on a 457 visa.
Are you asking about a temporary visa (457) or ENS (121/856)?

1. To clarify, I have been offered sponsored employment in Australia,
but would like to obtain a visa to work in my own right (I have what
would be regarded as a desirable profession). The question is, whilst
in Australia working as a sponsored employee, can I apply for either
temp. or perm working visa?

Which visa would you be working on as a sponsored employee in Australia?
A temporary (457) visa, or a permanent employer sponsored permanent visa
(121/856)? If you are already in Australia on a 121 visa, there would
be no need for you to apply for a further visa in your own right, as the
121 is a permanent visa (you are not tied to your employer).

Dear GJS,
The answers to your friend's questions are as follows:
a) If currently holding a 457 visa, no, no, possibly;
b) And if they relate to his situation after a subclass 121 or 856 ENS
visa is granted, yes, yes, yes. And indeed no obligation to remain
with the sponsoring employer.
