Default Embassy Suggest That My Fiancee have to Come Down and Get Married

Ok, I don't know where I am going to start. Maybe some of you here read
my stories. I will tell you again the story but not a long one.

My bf, filed a petition in Philippines when he was in the U.S. and moved
in Philippines with me for seven months. Then we moved together here in
Costa Rica, the day before we leave from Philippines, we got the notice
of action that the petition was approved. We still moved anyway and
transferred the case here in CR from Philippines and it took a year
before they transfer.

After a year, we got a notice of action again that the case was
transferred here in CR. We called the embassy and went to the
embassy showed some files again, they said that they don't have my
files, and they have to call the Philippines to forward the files to
CR, and they does not have it still. We wrote letter to the Nebraska
Center, submitted some files, and they told me that they don't have
it.They lost it.

The embassy told me that the best thing to do is refile the petition,
which my lawyer did last week of May. We did not hear anything from the
USCIS or from the Nebraska Center. We got a letter from them, this is
the letter.

My bf called them, and the lady didn't help him at all. It was useless
calling them cause the lady just said that they don't have my files and
if we refile the petition we should had received the receipt within 30
days after they received the petition.

I called my lawyer and told her that my bf called them and told her what
they said. My lawyer called the embassy here in CR. The embassy told her
that my lawyer have to submit all the documents we have to the embassy
and tell my bf to come down here in CR and marry me and file the
petition at the Consulate, it's sounds like a DCF. I read before and I
thought that CR does not allow DCF, and why they suggest it now? What is
going on here?

I want to marry my bf and be with him of course but he just got his job
8 months ago, we are paying our large debt right now, and we can't
afford for him to go back here from the U.S.. I don't want to lose his
job cause of this, then what? I don't want to screw up everything again
like we did before. It was not our fault that they lost my files, we did
everything right. Yeah, maybe moving here in CR from Philippines was the
wrong thing we did, but we already moved here, it's too late to go back
again in Philippines.

It's a good news that I am going to see my bf again after 9 months and
get married and be with him soon, but after that, we are going to be
homeless. What we should do? Please help, I am really frustrated.
Somebody help me please?

Sounds like the Consulate wants to do you a favor to make up for all
your troubles. Don't look a gift horse in the mouth, as the saying here
goes. They are inviting your BF to come to CR, marry and file the I-130
in CR. This can be accomplished in a short trip (assuming the marriage
part is not too time consuming in CR, but even that can be arranged
ahead of time. Tourists marry in CR all the time).

As to your financials etc, I can't offer anything based on what you've
said. I don't know why your BF would be jobless, doesn't have FF miles
to buy a ticket with or why you would be homeless if you go through with
this plan, or why you would go through with this plan if it would cause
you to be homeless, but together.

Thanks for the reply meauxna, I really appreciate for taking your time
to read and reply to my post.

Maybe I exagerate a bit, :) sorry. We are not going to be homeless
really, cause my bf got a good job, it's just we can't afford it and
wasting money. If marrying is only the best thing we can do, I think we
will go for it and sacrifice some things.

I called the embassy today to verify if my lawyer is telling the truth.
My lawyer is right, the lady at the embassy told me, that's the other
option we can do, marry here in CR and wait for the marriage certificate
and file the petition at the consulate.

you can't tell people a story like that and not tell us the date of
your wedding.
