Default EAD and drivers license experience in Denver

Hi guys,

Here is the latest from our endeavor to get part of my
paperwork completed. Since the 90 day period for the issuance of my EAD
by NBC expired, me and my hubby decided to go get the employment card on
the 91st day at the local USCIS office in Denver.

First, we were able
to get in to the local CIS office with minimum headache. We arrived at
the office around 6:15 and were number 17 in line. The office opened at
7:00 (not 7:30 as indicated on their website), so that was good. We had
no difficulty in explaining the situation to the CIS officer there, and
we were told to come back at 10:00 when they would issue the work
permit. We went out for breakfast and returned at 9:45. Around 10:30,
I was called in to the back of the office where they took my picture and
fingerprint -- and issued me a work permit.

Now begins the fun part
--- the work permit is only good for 90 days!! Every three months, I
will have to go in and reapply for a temporary permit until we go
through an interview and my AOS is approved! I hope that potential
employers understand this 90 day need to refresh her temporary
employment authorization. Is it normal that local USCIS offices would
issue temporary EADs valid for only 3 months!?!?! I've always thought
the EAD would be valid for one year....

This was just the beginning of
our fun day. From the CIS, we went to the Colorado Driver's License
office to change me from Washington to Colorado (I've been living in
Seattle for the past two years and had a WA drivers license good for 10
years). Imagine our surprise when we were told that I could not get a
Colorado driver's license until I have a residency card that shows that
I should be in Colorado --- the AOS approval is what I think the lady
was wanting to see. She did say that I could get a license if I had a
work permit, but the license would only be as good as the length of the
permit --- which is only three months!!!
So, I will have to pay the
license fee every three months before I become a legal resident of
Colorado...and that won't happen until the AOS process is completed!!!!


Does anyone have a similar experience with their first EAD and drivers
license? What doesn't make sense to me is, that I have a VALID
Washington State license, I'm married to a US citizen, I have a SSN and
I CAN'T get a regular drivers license in Colorado, although I HAVE to,
as an out-of-state driver, get a CO drivers licence within 30 days of
moving in to Colorado. This just doesn't make ANY sense to me....grrrr.


Anyway, I'm off to at least change my car's license plates from WA to
CO now.

it is my understanding that the
interim ead is only until nbc issues the one year ead.

It seems like you're not a "legal resident" of Colorado in the eyes of the
Colorado Motor Vehicle Divison until your AOS processing is complete. Fine.
Then you shouln't even need to get a Colorado license until after that.
Because you have to get a Colorado license within 30 days of becoming a
legal resident of Colorado. Which, according to them, happens when you
finish your AOS.

I'd think you can use your Washington drive's license until then.
